These terms apply when you use HowFastIsMyInternet.com. Please read them; by using the site you agree to them.

1. Agreement

These Terms of Use ("Terms") are an agreement between you and Birchwood Group, LLC ("we", "us"), a California limited liability company, 1390 Market Street, Suite 200, San Francisco, CA 94102-5404, United States. They govern your use of HowFastIsMyInternet.com, its subdomains, test servers and content (the "Service"). Our Privacy policy explains how information is handled and forms part of these Terms.

If you do not agree, do not use the Service. We may change these Terms; when we do, we update the "Last updated" date above. Continuing to use the Service after a change means you accept the revised Terms.

2. The Service

The Service is a free internet speed test that runs in your web browser. It measures download and upload speed, latency, jitter and latency under load, rates what your connection is suited for, and offers explanatory articles. It requires no account. Test results are kept in your browser; you can share or export them yourself. How each figure is calculated is described on the Methodology page.

Running a test transfers real data over your connection, up to the amount shown before you start. If your data is metered, data charges from your provider are your responsibility.

3. Results are information, not advice

Results reflect conditions between your device and our test servers at the time of the test. They can differ from the speed your provider advertises and from what a particular app experiences, for example because of Wi-Fi, other devices, your hardware, VPNs, network congestion or the time of day. Results, ratings and articles are general information. They are not professional, technical, legal or financial advice, and you should not rely on them alone for billing disputes, contract decisions, legal claims or equipment purchases.

4. Eligibility

You must be at least 13 years old, or the minimum age required where you live if that is higher, to use the Service. If you use the Service on behalf of an organization, you confirm that you are authorized to accept these Terms for it.

5. Acceptable use

You agree to use the Service only for lawful purposes. You will not:

  • run tests in an automated, excessive or abusive way, or otherwise overload, disrupt or interfere with the Service or its servers;
  • use the test servers as a general file host, traffic generator or load-testing target;
  • try to gain unauthorized access to the Service or circumvent its rate limits or security measures;
  • send malware or other harmful code to the Service;
  • scrape or republish the Service's content in bulk without our written permission;
  • use the Service for any fraudulent, misleading or unlawful purpose.

We may limit or block access, including by network address range, if we believe these Terms are being broken or the Service is at risk.

6. Intellectual property

The Service's content, design, text, graphics, logos and software (other than open-source components, which are licensed under their own terms) belong to Birchwood Group, LLC or its licensors and are protected by law. We grant you a limited, personal, non-exclusive, non-transferable and revocable license to use the Service. You may share your own test results freely. "HowFastIsMyInternet" and "HowFastIsMyInternet.com" are our trademarks and may not be used without our written permission.

If you believe content on the Service infringes your copyright, send a notice to the contact below that identifies the work, where it appears on the Service, your contact details, a statement of good-faith belief that the use is unauthorized, and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner.

The Service may link to other websites. We do not control them and are not responsible for their content, policies or practices.

8. Availability

We aim to keep the Service available but do not guarantee that it will be uninterrupted. We may change, suspend or discontinue any part of the Service at any time, with or without notice, and are not liable for doing so.

9. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE AND ALL RESULTS AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND THE ACCURACY OR RELIABILITY OF ANY RESULT. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO SOME OF THEM MAY NOT APPLY TO YOU.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BIRCHWOOD GROUP, LLC AND ITS OFFICERS, EMPLOYEES, AGENTS, AFFILIATES AND SERVICE PROVIDERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR FOR LOSS OF PROFITS, DATA, USE OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE, ANY RESULT, OR ANY DECISION MADE BASED ON A RESULT. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify and hold harmless Birchwood Group, LLC and its officers, employees, agents and affiliates from claims, losses and expenses (including reasonable attorneys' fees) arising from your misuse of the Service or your breach of these Terms or of any law or third-party right.

12. Dispute resolution

Informal resolution. Before starting a formal proceeding, you agree to contact us and try to resolve any dispute arising out of or relating to these Terms or the Service ("Dispute") informally for 60 days.

Binding arbitration. If a Dispute is not resolved informally, you and Birchwood Group, LLC agree to resolve it by final and binding arbitration rather than in court, administered by JAMS under its Streamlined Arbitration Rules and Procedures, or by another provider both parties agree on. The arbitration will take place in San Francisco County, California, unless the parties agree otherwise. The arbitrator may award the same remedies a court could, but may not conduct a class-wide arbitration.

Class action waiver. YOU AND BIRCHWOOD GROUP, LLC MAY BRING CLAIMS AGAINST EACH OTHER ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE ACTION.

Exceptions. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

13. Governing law

These Terms and any Dispute are governed by the laws of the State of California, United States, without regard to its conflict of law rules. Where arbitration does not apply, you consent to the exclusive jurisdiction of the state and federal courts in San Francisco County, California. If you are a consumer living in the European Economic Area, the United Kingdom or another place with mandatory consumer protection law, nothing in these Terms takes away the protection of those laws or your right to bring proceedings in your local courts.

14. General

  • Termination. We may suspend or end your access to the Service at any time if you breach these Terms. Sections that by their nature should survive, including 6 and 9 to 13, survive.
  • Entire agreement. These Terms and the Privacy policy are the entire agreement between you and us about the Service.
  • Severability. If a provision is found unenforceable, the rest remains in effect and that provision is enforced to the extent possible.
  • No waiver. Not enforcing a provision is not a waiver of it.
  • Assignment. You may not transfer these Terms without our consent. We may assign them.
  • International use. The Service is operated from the United States. If you use it from elsewhere, you are responsible for complying with local law.
  • Feedback. If you send us suggestions, we may use them without any obligation to you.
